CIRCUMSTANCES OF DISAPPEARANCE

On 8 August 1995, a column of 31 Assam Rifles from Charduar Head Quarter visited the Kangpokpi outpost in Senapati District, Manipur on official duty. Rifleman N.S. John was among them. The team stayed at Kangpokpi outpost for 3 days. On 11 August, the team left Kangpokpi for Charduar via TAC Head Quarter, Tamenglong District of Manipur. On return, it was found that Rfm. N.S. John was missing.

SEARCH EFFORTS

On 9 and 10 September 1995 Mr. N.S. Tuireishong, brother of N.S. John submitted representations to the Commanding Officer of 31st Assam Rifles, Waichung outpost, Kangpokpi and the Officer-in-charge of Kangpokpi police station to trace out his missing brother. On 11 June and again on 10 and 11 August of 1997, Ms. N.S. Yangneila, mother of John submitted memoranda to the Chief Minister of Manipur, the Commanding Officer of 31 Assam Rifles, Waichung Out Post, Kangpokpi Senapati District and the Chief Secretary, Government of Manipur to trace out the whereabouts of her son and for grant of ex-gratia payment.

On 23 September 1997, Captain S.K. Verma, Commandant of TAC Head Quarter wrote a letter to Ms. Yangneila that, the army authorities have conducted an inquiry and found that her son is a deserter.

On 28 April 1998, Ms. Yangneila moved a writ of Habeas Corpus to the Gauhati High Court. The case is registered as Civil Rule (HC) No. 8 of 1998.

On 6 August 1999, the High Court issued a direction to the Director General of Police, Government of Manipur asking him to carry an inquiry and submit his report to the court within two months.

PRESENT STATUS

At the time of filing this report, the inquiry has not yet started. The whereabouts of Mr. N.S. John is still not known. Advocate R. Daniel is representing the petitioner in the Court.
