The Love and Loss of Cheyenne

By David Meyer

Former President of Last Chance For Animals

Words cannot express the sadness I feel at the recent loss of my nine-year companion and close friend, Cheyenne, a hundred pound shepherd mix.  He died on Saturday, October 30, just 2 days after my birthday. One would not think that the loss of a dog would have such a profound impact on a person, but he continues to teach and surprise me even in his death.

I've made a career out of seeing suffering and death of animals and limiting my emotional reaction, but with Cheyenne this is not possible -- I'm distraught. He was an integral part of my family and my life, he was a source of joy and support for me, and was among my closest friends. He was a part of my daily routine, an integral part of my world, my plans, and my actions for almost a decade. And his death is made more difficult for me by a deep sense of guilt -- a true irony -- that in my fanatic attempt to devote all my attention to save the animals of the world, neglected giving the proper attention to animals in my own home and family.

I adopted him from a rescue kennel in Canoga Park. I had asked for their biggest dog, and they took me to "Scooner", a 2 year old, lanky, goofy looking dog with scars on his head and a piece of his ear missing. They told me he had been caged for a year, and had been returned by a family because he had fought with their other dog. I looked at his bouncing gate and excited and friendly attitude and insisted that he was free forever of his cage. His name was now Cheyenne and he was coming home with us.

We took him to the car and it was clear he needed to stretch his elongated legs. As Shama waited, I began to run with him down the street.  I instantly found myself sprinting at full speed, being dragged even faster forward by a dog who had been caged for so long. He was born to run -- he didn't like leashes. His energy was endless, and as we put him in the car, we knew his life was about to change. He was going to our home in Agua Dulce, with a full two acres of backyard and his new lifelong companion, Poki.

The years can't be summed up in one story. His many fun and odd antics. One of the first days in his new home when our housemate (who was a hunter, of all things) yelled at Cheyenne to get off his favorite bean-bag chair. Cheyenne immediately obliged, but before leaving the room, he lifted his leg and emptied his entire bladder on the chair before the hunter's stunned eyes.

The time he started a stampede of cattle running our way in the middle of the night in the Golden Trout Wilderness as Shama and I sat trembling in our tent.

The way he would chase me on my runs in the mountains, inspiring me to run faster by nipping at my arms and at my rear end.

His insistence on jumping into the car whenever the door was open -- and staying in there until we went somewhere fun.

The way he would literally sit on my head, posting a quiet guard on my squirming body.

His never failing habit of passing me on a walk by brushing under my down-stretched fingers to let me know he was at my side.

The time we went camping and he passed me on a thin ridge by brushing under my down-stretched fingers to let me know he was at my side -- as his strapped-on saddlebags with his food nearly knocked me of the cliff.

His game of pretending to be asleep at home and then lurching forward with a viscous growl in hot pursuit of a passing cat, only to corner his little friend and caress him gently with his nose.

His curious habit of drinking a lot of water before bed time, then happily running toward the bed for a pat on the head, only to burp up the water onto the sheets. This may not sound like a happy memory, but you just had to know the "Glorfman" to appreciate it.

His love of small dogs, and his love affair with the dachshund across the street.

His faithful return to my calls and whistles. His loyalty to me and Poki, to the cats, to Shama and then to Genia, who helped me realize how needy he had become and helped me care for him.

In the second half of his life, health issues continued to plague him.  Surgery on both knees, onset of seizures, arthritis in his spine.  His spirit never waned, even as our runs turned into walks. Even lying down and getting up became a difficult chore. His medication time became a regular fixture of his, my and Genia's lives, getting me out of bed in the mornings and making me come home virtually every night for years.  He didn't like the pills, didn't like the squirts of fluid in his mouth, but always willingly came to me and let me give them to him.  He was the very definition of a "Good Boy".

He was there for me through my divorce, always present and a gift in my life -- Me, Poki and Chey (pronounced Shy). Even as walking became difficult, he could always jump up and spin around when it was time for a walk, heralding the upcoming adventure with his characteristic and slow "Wooo Wooo Wooo". He was the dog I called Bubberific -- the Munker -- the Big Baloonias and many other names. But he was just Cheyenne. In every asked for attention, he also said to me "you are important" and "I need you".

I wasn't there when he needed me most.

Genia and I were at a press conference helping animals, and then exercising near the beach. His intestines twisted and in a condition apparently not uncommon in some older large dogs, his stomach bloated.  Over a span of what must have been unbearably painful hours he died without me at his side -- a place I had always promised to be. I had heard of this condition, and always knew it was the odd type of thing that would probably kill him. I had just discussed it several weeks before with my friend Paula who is a vet.

I cannot have been with him every moment, and perhaps the surgical remedy for this condition would simply have been another in a growing list of painful conditions for a dog who was physically deteriorating. But I could have kept him bathed and more desirable for longer petting from my hands. We wanted to take him swimming. His favorite swimming hole had dried for the summer, and there was no water hole we could either find, or he could hike to with his weakening body. We were going to take him to a lake the next day and willingly accept a fine for breaking the law to let him swim. Genia had just moved in, which promised to mean a great deal more attention for Chey and my other animals. Chey won't get that attention now -- attention he so deserved.

So I say to him that I love him forever. I miss him in every room of the house and in every mountain. I'm sorry I didn't give him more love, more attention. I'm sorry I didn't take him swimming more often. I'm sorry I neglected him for the fur campaign. I thank him for nine years of daily love and friendship. I miss him. Poki misses him. Genia misses him. The world has dulled its colors in tribute to a lost and lovely boy. And I say to God, give him peace and freedom. Let him run free - Cheyenne does not wear a leash. Feed him Natures Recipe Vegetarian dog food, and he won't be needing his pills. And please, give him a bath and take him swimming. I couldn't. And forgive me if I don't save the animals of the world for at least a few days.  This desk and computer at which I sit took my attention away from him and I hate them.

And for those who think that a dog is "just a dog", that the entire world can't have changed because there is one less pair of eyes looking at you every morning, it is your loss to never know the true and divine meaning of real unconditional love, unconditional and complete trust, and never ending friendship.  No human can ever give it.

Youth Corps for Animals

I am writing you today to ask for information on your youth volunteer and/or internship program.  We at Youth Corps for Animals (YCA) are assembling a list of animal protection organizations that would like to increase their work with young people wishing to volunteer for the animals.  (You may have received an email like this some months ago.  If so, I apologize.  This project was just restarted after a break of a few months and I may be duplicating some of the work that had already been done.)

The YCA website will enable young people interested in helping animals to find a variety of volunteer and internship opportunities with diverse animal protection organizations.  The underlying concept of YCA is to connect young people to their specific areas of interest in the animal protection movement, and to introduce them to the organizations in their communities.  The website will allow young people easy access to information regarding local animal protection organizations and/or organizations whose work is specific to their areas of interest.

Stop Animal Pornography on the Web

How many times have you been surfing the internet or doing a search on an engine for pet/animal related material and have come across disgusting sites hosting "Bestiality Hard Core Pornography" displaying illegal images or movie clips with humans having sex with animals?

I know I have all to much! The act of Bestiality alone is illegal in 24 States in the USA and deemed "animal abuse" by the Humane Society of the United States!

The displaying of pornographic Bestiality images is illegal under Federal Obscenity Laws just like "Child Pornography" in ALL of the USA, but seldom gets enforced as it is given low priority with Federal Law Enforcement.

Did you ever stop and think, people sexually abusing animals could eventually start doing the same to our children?  Wives? Friends? and Mothers?  Just as Serial Killers who start by abusing animals, later start abusing and murdering humans!

We need to put a stop to this now!!!  Before our own children, family and friends are next!!! We need to let our Federal and Local Law Enforcement Agencies know to take this type of pornography seriously, just like they do with child pornography!!!  The one is just as illegal as the other!!!

We can start by emailing our Legislators and Federal Law Enforcement Agencies and ask them to start enforcing the already existing laws that make this type of pornography illegal, and let them know we do not want our children to be the next victims of these sexual animal abusers and their illegal online Hard Core Pornography!!!

If you find a USA based* site online displaying Bestiality Hard Core Pornography PLEASE report it to the Regional FBI Office**, State Attorney General***, and Local Law Enforcement**** where the site owner and hosting ISP are located.

*you can visit http://www.samspade.org  and run the site URL through their tools to find the location of the site owner, hosting ISP, and their uplinks.

Below are some extracts from current Federal Laws and Cases that can be used to prosecute the owners and ISP's of these US Based Illegal Pornography Sites!

<> <> <> <> <> <> <> <> <>

I would like to take this opportunity to provide some information to you, and those involved who may not have been aware of these facts regarding bestiality images and the acts:

1) Bestiality is *illegal* in 24 states, Canada, UK, Australia and many countries besides, the well known "Humane Society of the US" has a fairly extensive law citation page researched by their cruelty investigators located at: http://www.hsus.org/current/state_laws.html

2) "At least 24 states have laws prohibiting sex with animals (AR, CA, DE, GA, ID, KS, LA, MD, MA, MI, MN, MS, MT, NE, NY, NC, ND, OK, PA, RI, SC, UT, VA, and WI). Three of these states (DE, KS, and MT) include prohibitions against forcing someone else to commit a sexual act with an animal."  " In 5 states (DE, MI, NC, SC, and VA) animal sexual abuse is a felony. Two states (MA and RI) may imprison offenders for up to 20 years. Four states (OK, MT, MS, and MD) may imprison offenders for up to 10 years. Montana may also fine an offender up to $50,000. In Louisiana, up to five years of hard labor may be imposed on a convicted offender. "

FEDERAL LAWS

US *Federal laws* apply to bestiality related materials of *ANY kind* under the obscenity code and the Roth test for community standards, the law clearly states "interactive computers" are included as a transfer method this law covers. This was upheld in the federal courts in:

UNITED STATES OF AMERICA

Plaintiff-Appellee

v

ROBERT ALAN THOMAS (94-6648)

and CARLEEN THOMAS (94-6649),

Defendants-Appellants

"The computer-generated images and videotapes involved here portrayed bestiality, incest, rape, and sex scenes involving defecation, urination, and sado-masochistic abuse."

(Full Text of this case can be read at:      http://www.jmls.edu/cyber/cases/thomas.html)

Below you will find inclusion of both the Roth test as well as the federal codes which apply, courtesy of several sources, but especially this site which details federal laws:  http://www.geocities.com/CapitolHill/2269/USC.html

US Code :1465 Chapter 71 Obscenity

US Code : Title 18, Section 1465

US Code as of: 01/26/98

Sec. 1465. Transportation of obscene matters for sale or distribution

Whoever knowingly transports or travels in, or uses a facility or means of, interstate or foreign commerce or an interactive computer service (as defined in section 230(e)(2) of the Communications Act of 1934) in or affecting such commerce for the purpose of sale or distribution of any obscene, lewd, lascivious, or filthy book, pamphlet, picture, film, paper, letter, writing, print, silhouette, drawing, figure, image, cast, phonograph recording, electrical transcription or other article capable of producing sound or any other matter of indecent or immoral character, shall be fined under this title or imprisoned not more than five years, or both.

The transportation as aforesaid of two or more copies of any publication or two or more of any article of the character described above, or a combined total of five such publications and articles, shall create a presumption that such publications or articles are intended for sale or distribution, but such presumption shall be rebuttable.

US Code : Title 18, Section 1462

US Code as of: 01/26/98

Sec. 1462. Importation or transportation of obscene matters

Whoever brings into the United States, or any place subject to the jurisdiction thereof, or knowingly uses any express company or other common carrier or interactive computer service (as defined in section 230(e)(2) of the Communications Act of 1934), for carriage in interstate or foreign commerce -

(a) any obscene, lewd, lascivious, or filthy book, pamphlet, picture, motion-picture film, paper, letter, writing, print, or other matter of indecent character; or

(b) any obscene, lewd, lascivious, or filthy phonograph recording, electrical transcription, or other article or thing capable of producing sound; or

(c) any drug, medicine, article, or thing designed, adapted, or intended for producing abortion, or for any indecent or immoral use; or any written or printed card, letter, circular, book, pamphlet, advertisement, or notice of any kind giving information, directly or indirectly, where, how, or of whom, or by what means any of such mentioned articles, matters, or things may be obtained or made; or

Whoever knowingly takes or receives, from such express company or other  common carrier or interactive computer service (as defined in section 230(e)(2) of the Communications Act of 1934) any matter or thing the carriage or importation of which is herein made unlawful

Shall be fined under this title or imprisoned not more than five years, or both, for the first such offense and shall be fined under this title or imprisoned not more than ten years, or both, for each such offense thereafter.

There is no federal law which prohibits sex between humans and animals.  There are a few federal laws, however, which list bestiality, along with many other forms of sex, which are prohibited when involving children

(18 USCS@ 2256, 3509 (1994)

The Roth Test In 1957, the U.S. Supreme Court developed the Roth Test to define obscenity. The Roth Test requires that the court ask whether to the average person, applying contemporary community standards, the dominant theme of the material taken as a whole appeals to prurient interest (Roth v. United States, 354 US 476,

Since the Roth decision, the Supreme Court has added that such material must be utterly without redeeming social values.

United States Code Chapter 71; Obscenity Section Content:

            1460 Possession with intent to sell, and sale, of obscene matter on Federal

                        property

            1461 Mailing obscene or crime-inciting matter

            1462 Importation or transportation of obscene matters

            1463 Mailing indecent matter on wrappers or envelopes

            1464 Broadcasting obscene language

            1465 Transportation of obscene matters for sale or distribution

            1466 Engaging in the business of selling or transferring obscene matter

            1467 Criminal forfeiture

            1468 Distributing obscene material by cable or subscription television

            1469 Presumptions

In Armijo v. U.S., 384 F2d 694, The court ruled that portions of letters describing in detail degenerate bestiality were not merely obscene but represented hard-core pornography.

The federal code most damaging to hard core pornography (bestiality) is 18 USCS @ 1461, which prohibits obscene books as mailable. In the case U.S. v. Miller 455 F.2d 899, this statute was applied by court to find that books describing bestiality between women and a dog were unmailable.

Now remember the Roth Test...So now you know Bestiality Pornography can't be mailed, imported, transported, broadcasted, transported, sold, transferred, or distributed via cable or subscription television.

Criminal forfeiture: Code 1467 says that the courts can take any property that involved the obscenity law being broken. This could be your VCR, your car, your computer, etcetera. You forfeited them when you used them to break the law.

Presumptions: Code 1469 means that if there is any evidence that the material was made somewhere else, be it direct evidence or even circumstantial evidence, then the courts will immediately assume it was transported and therefore violated Code 1462 as well.

Benefits of Landscaping For Birds

At least ten benefits can be derived from landscaping to attract birds to your yard:

* Increased Wildlife Populations

You can probably double the number of bird species using your property with a good landscaping plan.

* Energy Conservation

By carefully arranging your conifer and hardwood trees, you can lower winter heating and summer cooling bills for your house.

* Soil Conservation

Certain landscape plants can prevent soil erosion.

* Natural Beauty

A good landscaping plan will contribute to a beautiful, natural setting around your home that is pleasing to people as well as birds.

* Wildlife Photography

Wildlife photography is a wonderful hobby for people of all ages.

* Birdwatching

A fun hobby is to keep a list of all the birds seen in your yard or from your yard. Some people have counted over 190 species of birds in their yard!

* Natural Insect Control

Birds such as tree swallows, house wrens, brown thrashers, and orioles eat a variety of insects.

* Food Production

Some plants that attract wildlife are also appealing to people. Cherries, chokecherries, strawberries, and crabapples can be shared by people and wildlife.

* Property Value

A good landscaping plan can greatly increase the value of your property by adding natural beauty and an abundance of wildlife.

* Habitat for Kids

Some of the best wildlife habitats are the best "habitats" for young people to discover the wonders of nature. A backyard habitat can stimulate young people to develop a lifelong interest in wildlife and conservation.

BASICS OF LANDSCAPING FOR BIRDS

Landscaping for birds involves nine basic principles:

* Food

Every bird species has its own unique food requirements, and these may change as the bird matures and as the seasons change. Learn the food habits of the birds you wish to attract. Then plant the appropriate trees, shrubs, or flowers that will provide the fruits, berries, grains, seeds, acorns, nuts, or nectar.

* Water

You can probably double the number of bird species in your yard by providing a source of water. A frog pond, water garden, or bird bath will get lots of bird use, especially if the water is dripping, splashing, or moving.

* Shelter

Birds need places where they can hide from predators and escape from severe weather. Trees (including hollow ones), shrubs, tall grass, and bird houses provide excellent shelter.

* Diversity

The best landscaping plan is one that includes a wide variety of plants. This helps attract a greater number of bird species.

* Four Seasons

It is necessary to provide birds with food and shelter during all four seasons of the year. Plant trees, shrubs, and flowers that will provide year-round food and shelter.

* Arrangement

Habitat components need to be properly arranged. Consider the effects of prevailing winds (and snow drifting) so your yard will be protected from harsh winter weather.

* Protection

Birds should be protected from unnecessary mortality. When choosing the placement of bird feeders and nest boxes, consider their accessibility to predators.

Picture windows can be death traps for birds. A network of parallel, vertical strings spaced 4 inches apart can be placed on the outside of windows to prevent this problem.

You also should be cautious about the kinds of herbicides and pesticides used in your yard. They should be applied only when necessary and strictly according to label instructions.

* Hardiness Zones

When considering plants not native to your area, consult a plant hardiness zone map (they are in most garden catalogues). Make sure the plants you want are rated for the winter hardiness zone classification of your area.

* Soils and Topography

Consult with your local garden center, university, or county extension office to have a soil test done for your yard. Plant species are often adapted to certain types of soils. By knowing what type of soil you have, you can identify the types of plants that should grow best in your yard.

Resources For Dealing With Animal Abusers

Psychologists for the Ethical Treatment of Animals (PSYETA) recognize that animal abusers deserve not only jail time, but need psychological counseling.  Many states now realize this.  The cruelty statutes of California, Colorado, Maryland, Michigan, Minnesota, Oregon, Vermont, Virginia, and Washington authorize psychological counseling, making it more likely that judges will recommend treatment.

PSYETA has developed the AniCare Model Treatment Program for Animal Abusers.  A cognitive behavioral model, AniCare "challenges maladaptive attitudes and beliefs about animals, explores family history, and educates clients about how social factors such as pseudo-masculinity and anthropocentrism, may encourage the abuse of animals."  A mental health professional can use the AniCare treatment model to help the abuser recognize and break the cycle of violence in which animal abuse leads to violence directed against humans.

If you would like to make law enforcement officials and social service providers in your area aware of the AniCare Model, you can reach PSYETA in Maryland at (301) 963-4751; or by e-mail at:  kshapiro@igc.org

or by regular mail at :

Simple Steps to End Animal Suffering

There is so much animal abuse that occurs every second. What can I possibly do that will have any effect?

DON’T CONTRIBUTE TO ANIMAL SUFFERING. Before we can ask others to stop harming animals, we must eliminate all forms of animal cruelty in our lives:

•Go vegan.

•Boycott companies that conduct animal tests.

•Refuse to wear animals (fur, leather, wool, etc.).

•Boycott events that profit off of animal "entertainment" (circuses, rodeos, zoos, aquariums, etc.).

EDUCATE YOURSELF ABOUT ANIMAL EXPLOITATION. Pick up some of the following books and share them with friends:

•Animal Liberation by Peter Singer

•The Case for Animal Rights by Tom Regan

•Diet for a New America by John Robbins

GET INVOLVED IN THE ANIMAL RIGHTS MOVEMENT.

•Volunteer at local pro-animal organizations.

•Attend animal rights demonstrations in your area.

•If there are no groups in your area, start organizing!

EDUCATE OTHERS ABOUT THE PLIGHT OF ANIMALS on factory farms, in labs, or other areas where they are exploited.

Good Intentions Aren’t Good Enough…GET ACTIVE!

A Small Moment in Time

by parogers@mindspring.com (Patricia Rogers)

Sitting on the steps

staring at the sidewalk,

lost in thoughts I no longer remember.

Movement broke the clear

nothingness of the moment.

My eyes focused now --

studying the walk

searching until they found

the source of the disturbance.

An insect, small and nondescript.

On his back, legs grasping at the sky,

trying to gain a foothold in the air.

Ignorant,

I leaned forward and turned him over

thinking to give him the footing he was so desperately seeking.

He fell over on his back,

legs again grasping at the sky.

Now quickly, now slowly, now not at all.

And as I watched,

powerless to help or heal,

I began to understand

the fear of the unknown

and will to live

that is in us all.
