SEXUAL ASSAULT

Most sexual assault experiences are not reported, and many of them are not even talked about. This often occurs because the victim does not know what to do, or where to turn.

Definition: Sexual assault can include anything from sexual harassment, sexual molestation, and sexual abuse to rape.

All of these things can be traumatic, devastating and effect a person for a life time.

Sexual assault can involve:

 Children molested by peers, siblings, adults, parents, or stepparents.
 Males raped or molested by other males or by females.
 Date rape.
 Rape by a known, trusted person.
 Sexual abuse, rapes, or assaults by a stranger.

Sexual abuse and rape are not legal terms in the state of Florida. The official term/charge is usually "Lewd and Lascivious behavior" or "Sexual Battery". Sexual Battery (FS 794.011) is defined as oral, anal, or vaginal penetration by or union with, the sexual organ of another, or, the anal or vaginal penetration of another by another object. Sexual battery is a felony in Florida.

Consent is not the same as Submission. Consent, is an issue in sexual battery cases. The statute defines consent as intelligent knowing, and voluntary consent and does not include coerced submission (in other words if someone threatens you into submission it is still rape, and they can be charged with sexual battery.).

Power and Control

Rape, sexual abuse, sexual assault, sexual harassment are all about power and control. It is about one-persons domination of another. It is not about sex, where two people willingly participate in a pleasurable activity. It is about one person not caring what the other person thinks or feels. It is about owning and controlling. It is about thinking a person is an object without feelings. Sexually abusive individuals are often verbally abusive and many are also physically abusive.

 NO ONE deserves to be abused.
 Everyone has the right to say no at any point and time.
 Everyone has the right to say how, when, where and who touches him or her.

Statistics

 There are 1.3 rapes per minute.

 1 in 4 college students experience a rape or an attempted rape.

 1 in 5 women will experience a rape or an attempted rape in her lifetime.

 1 in 3 women will experience an attack, an attempted rape, a rape or sexual abuse in her lifetime.

  27% of females age 15-19 have been victims of rape or attempted rape. Of them 84% knew their attackers.

  57% of all rapes occur on a date.

  61% of all rapes, the victims are less than 18 years old.

  65% of all rapes occur by someone that is known to the victim.

  85-90% of rapes go unreported.

  1 in ? teen couples experience dating violence.

  1 in 12 males admit to committing acts that are legally defined as rape.

  Approximately 50% of all rapists are under the age of 25.

  75% of the acknowledged date rapists interviewed admitted that they got the female drunk in order to increase the likelihood of her having sex with him.

Corrected Myths

 Rape is not about sex; it is about power and control.

 Most rapes do not occur by a stranger.

 Men, women, children and the elderly can be and are raped. (Youngest in FL is 2 months, oldest is 93)

 Most rapists are not caught, because most rapes are not reported.

 Rapes occur in all races, cultures, religion and socioeconomic groups.

 The highest risk factor for rape is being female.

 Rapist rape about 8-9 times before they are caught. Another good reason to report, even an attempted rape.

 Rarely does a rapist ever do this just once. (Good reason to report)

 Rape victims are not always young, attractive, or promiscuously dressed.

 How a person dresses DOES NOT cause rape. A rapist's action thought etc.cause the rape. The victim does not ever cause a rape. (How a person dresses is not admissible in court in the state of Florida)

 It is now illegal in every state for a person to rape their spouse.

 MOST rapes are not reported. Submission and consent are not the same thing. NO ONE ever wants to be forced into any act they don't want to commit. No human being secretly wants to be raped.

 Sex is not an obligation because of expensive gifts, and fancy dates. Sex is a free adult choice (a choice to say yes, or a choice to say no). A person who is sexually abusive or physically abusive is usually verbally abusive. If a person is verbally are you willing to discover that they are also sexually or physically abusive? Say NO to all forms of abuse.

 Sexual abuse can be as traumatic as rape.

 Alcohol is not a defense for rape. The behavior of an intoxicated individual is still their own responsibility and will be held accountable for it. It is bad enough to wake up with a hangover, but to wake up and find out you are a rapist is even worse.

 Alcohol can dull the very senses that may protect and warn you of impeding danger.

 Alcohol and substances are often involved in rape.

FALSE REPORTS

 Falsely accusing anyone of rape is against the law in Florida, and you can go to jail for seeking this type of revenge.

THE FORENSICS EXAM

The purpose of this exam is to collect evidence. Evidence from your clothes, body, saliva, hair, and nails is all useful in corroborating your story. Evidence is collected from your mouth, your vagina, and anus. This seems very invasive and uncomfortable, but is absolutely necessary in the prosecution process. It can make or break a case. Blood samples are usually taken as well.
 Evidence can be collected up to several days after the event, but the best evidence is collected immediately.
 After the evidence is collected, sexually transmitted diseases are discussed and preventative treatment provided, most emergency departments also discuss pregnancy prevention options or will provide and appropriate referral. AIDS testing can only be mandated of the perpetrator, if he is charged with the crime.
 C.A.R.E. (941-475-6465 or 941-627-6000) volunteers are always available to support victims through the emergency department and forensic evidence process.

RAPE SERVICES

 We provide 24 hour on call team that responds to the local emergency department when a rape victim presents for a forensic exam Forensic Exam.
 We have volunteers that are willing to go with the victim to report this to law enforcement and then will follow through the whole court process.
 We have licensed counselors that can provide counseling for victims even if the incident happened in the past or in another location.
 We have educators that do school, community, and professional presentations on rape prevention and awareness.

SAFETY TIPS

 Never travel alone.
 Stay in well-lit, well-traveled areas after dark.
 Know your date before being alone with them.
 Listen to rumors….if a person has done this once they may do it again.
 Do not tolerate verbal abuse.
 DO NOT TOLERATE ANY ABUSE EVER!
 Avoid alcohol and other numbing dulling substances.
 Be self-confident.
 Fight off an attacker when you can, shout, holler, scream, kick, hit, bite.
 Use any object you can to fend for yourself.
 If you are afraid for your life then it is OK to be quiet and cooperate.

Remember

EVERYONE HAS THE RIGHT TO SAY NO!

It is never the victim's fault.

Say NO clearly.

You can say no at any point, in even the most intimate relationship.

If you are the aggressive person, be aware that yes means yes, and EVERYTHING else means NO!!!!!!

If you are aggressively coerce someone into having sex against their will, you can be charged with sexual battery, that is a felony, you can go to jail.
