“EUROPEAN COUNCIL : OCALAN WAS TRIED FAIRLY”

“European Council has acknowledged that the court has acted fairly during the trial of Ocalan. Representatives of the Euoropean Council, who attended the court hearings held between May 31 and June 08, have emphasized in their reports declared in Strasbourg that the case was heard in a way perfectly compatible with the Turkish legislation.

In the foregoing report, it was stated that the judges and prosecutors behaved kindly to Ocalan.

Before the court, Ocalan has to account for his actions intended to undermine the integrity of the Republic of Turkey with the aim of establishing an independent Kurdish state.

At the beginning of the trial, responding to the accusations directed at himself, Ocalan admitted that he also found himself guilty”.

In the report prepared by the European Council, it was declared that the trial of Abdullah Ocalan, leader of Kurdish rebels, had been conducted in compliance with the principles of justice.

The Council, which had been established after the end of Second World War with the aim of  improving democracy and human rights in Europe, closely monitors the way Turkey behaves to the separatist Kurdish leader, captured in Kenya in February.

“According to Walter Schwimmer, the Council of Europe Rapporteur for Turkey, the trial of Ocalan was very calm and fair. Schwimmer stated that the accused Ocalan and his lawyers had all the opportunities for taking turns to speak.

Observing the trial on Imraly, Schwimmer said that the head of the court prevented completely any attempt to interfere made by the families of the soldiers who are in the courtroom.”

The Massacre of the PKK in the village...

“A diplomat from the German Embassy who was present in the court with the aim of watching the trial expressed his surprise that such a long period of time had been given to Ocalan for conducting his defense and defined the trial extremely fair.

Appearing before the judge, the PKK leader Ocalan said that he was not tortured or verbally insulted. He had also made a similar statement on the date when he was brought from Kenya to Turkey.”

“MURAT”

             

                “While the wife of an officer, Yildiz Namdar was telling about what had happened to her with tears on her eyes, the judge could not help crying and even Abdullah Ocalan was touched. ‘I warned him. I said they were all   terrorists, but he said 'Don’t be afraid' and calmed me down,’ said Namdar.

                 

               Yet in 1995 the PKK members stopped the couple Murat and Yildiz on a secondary road in the Southeastern Anatolia of Turkey and took 23-year-old Murat out of the car and took him away. They shot him a bullet in the head and ran away to the mountains.

Yildiz Namdar  said “Murat would not discriminate among the people. He would even give money to the soldiers of Kurdish origin when they went on leave. I asked ‘For God’s sake what have we done to you? Why do you hate us?’ Murat was everything to me.” This was what Yildiz the nurse was telling about while crying in the hearing of the suit filed against Ocalan, the PKK leader on the island of Imrali. The relatives of each soldier killed had tragic things to tell.

The dead soldiers’ relatives who could not go to the Island were standing with fortitude on the quay of Mudanya with the photographs of their slain loved ones on their chests and were cursing Ocalan. The mother of a soldier who had been killed by the PKK members one month before his military service was over thought that even the death penalty would not be enough for Ocalan.

After the trial is over, now I keep on asking myself why I did not deal with the situation of these families more.”
