Memorandum of Protocol
of 22.08.1996
Constitutional Counsel.
Parliament of Graciosa.
United around the Staff,
we, the Ten Thousand,
speaking as the first ones of the people:
The provisionally composed
parliament
is a transition phase toward the inevitable.
We, the first ones of the people,
have
approved and ratified, and promise to fulfil and to observe that it
will
be fulfilled, punctually and in all its parts:
the own-ness of
the germinal force,
that gives form to our identity,
the absence of symbols and the
limitation
of structures
the moderation of laws
The parliament has the
right to perform
its mission and to integrate the provisional disposal into the final
protocol,
recognizing its juridical civil personality in conformity with the
statute
of its state and constitution, the free and juridical execution of the
activities which are proper to it.
Due to its temporary character and
composition,
the present Parliament can organize itself freely.
It can, more specifically, create
the
territorial definition and limits, and observe that the four competent
organs of the state have the civil and juridical personality.
It can also create, approve or
dissolve
institutions, co-operate with foreign associations or institutions; it
has, in other words, the full capacity of handling in the name of the
four
competent organs and their institutions with respect to their
possessions
and all other necessary identities and foundations, from the date on
which
the present protocol has been approved and takes effect, in virtue of
this
authentic document in which the representative organs, the competencies
of the said organs are integrated, in order to determine the extension
and limits of the competencies and thus dispose, will be effective and
will act in this case as statutory right.
The Parliament respects and protects
the
unassailability of the identities. In order to have the greatest power
and the greatest effect, we order that this instrument of ratification,
assigned by us, by which we adjudge the most extensive power to whom is
authorized, has full powers of the Parliament.
Seen and examined the temporary
disposals
which integrate the final protocol.
Approved by this Parliament and
approved
the ratification, that the statute of these identities of the eqlibrium
the natural identity of sovereignty, is the source off all
legitimization.
