0700 LOCAL

THE OFFICE OF

THE JUDGE ADVOCATE GENERAL

 

AJ had struggled with the problem for the whole night.  There was nothing to be done he had to team Mackenzie and Rabb together on a case. DAMN IT! He was not happy, this was happening too often.  Dawn broke and found him in a foul mood.  0700 arrived and he was like an injured bear.

 

Harm and Mac arrived, “The Admiral sent for us Tiner.” Mac stated.

 

“Yes ma’am… sir. Red Alert.”

 

The two paused “Understood… and thanks.” Harm acknowledged and knocked on the door.

 

“ENTER!!!” AJ roared.

 

They took a deep breath and entered it was going to be one of those days.

 

“Sit” AJ barked.  “Have a case for the two of you.” He began.

 

Neither of the senior JAG office uttered a word about his policy on them not working together.

 

“Woman was found dead at the War College. Her husband, Lt. Col. Avery Dax is the main suspect.  Commander you’ll defend Colonel you’ll prosecute.”

 

“Sir I have been negotiating with Commander Turner for one of his cases.” Mac imparted to her CO.

 

“I know which one that is and it’s not possible. The Commander is already at Leavenworth and this case has urgent stamped all over it.”

 

“But sir!” Mac began to protest. This case was dear to her.

 

“That’ll be all.” AJ dismissed the duo.

 

“Aye sir!” They rose.

 

Outside the office “Remind me not to get on the Admiral’s bad side.” Harm stated.

 

Mac made no response and headed to her office to read the file.

Two hours later Harm tapped on his wife’s door.  “Ready to negotiate Colonel?”

 

“Dishonorable discharge, loss of all benefits life in prison without parole.”

 

“Why not just execute him Mac!”


”Its premeditated murder. What does he want a medal?”

 

“Unacceptable.”

”Then see you in court.”

 

He got up and left.

NAVL DETENTION BARRACKS

LEAVENWORTH, KANSAS

 

“Colonel.” Sturgis welcomed the older man into the room.

 

“I was expecting Lt. Col. Mackenzie.” Matt stated.

 

“I realize that sir, but the Admiral has her on another case and sent me to represent you.”  Sturgis explained.

 

“I see.”  Matt sat.  “What happens now?”

 

“Well the parole board will convene tomorrow at 1000 hours I’m confident that they will grant the petition.”

 

“I hope you are right Commander it would be nice to be on the outside.”

 

“Indeed sir indeed.”

JAG DETENTION BARRACKS
 

“I’m Commander Rabb, this is Lt. Atkins we’ll be representing you in your upcoming trial.”  Harm said to his new client.

 

The man took a seat before them.  “What happens now?”

 

“Tell us your side of the story.” Atkins instructed.

 

“OK” He licked his lips. “Adrienne went jogging every evening. I went in the morning she went in the evening.  This night when I saw it was getting late I called the police and reported her missing.”

 

Atkins was taking notes.

 

“According to our information you called the next morning.”  Harm pressed.

 

“Yes I did.”

 

“Why?” Harm demanded.

 

The man looked dazed. “I just kept thinking that she’d walk through the door.” He wailed. “What’s going to happen to me!”

 

“Well we are going to court martial.  We’ll put in a plea…”

 

“I’ve decided to delay entering a plea of guilty or not guilty until the start of his trial.” Dax announced.

 

“Say again?”  Atkins was surprised.

 

“You heard me.” Dax replied.  It was a total change from the man of a few seconds ago.

 

“We did Colonel we did.” Harm stood. “We’ll be in touch.”

 

After the guards took him away Atkins made an observation. “Did you notice sir that he never asked about his children?”

 

“Yes I did.” Harm picked up his cover and walked out followed by the younger lawyer.

ROBERTS’ RESIDENCE

 

It wasn’t often that the Roberts men were left to their own devices.  Bud relished the time with AJ.

 

“So how’s school?” Bud inquired as the two lay on their back in the yard and looked at the stars. Well as it turned out only one was looking at the stars.

 

“OK.” AJ replied.

 

“Just ok? Isn’t your teacher nice?”

 

“She’s ok.”

 

“How’s Bobby.” Bud pressed.

 

“He’s ok.”

 

“You seem to be in an OK mood son.” He teased.

 

“I’m ok.”

 

“Something bothering you?”

 

“Dad?”

 

“Yes.”

 

“Can I have a tree house?”

NAVL DETENTION BARRACKS

LEAVENWORTH, KANSAS

 

Former Colonel Matt O’Hara stood outside the gate of Leavenworth and took a deep deep breath. “Commander…”

 

“Sturgis.” He corrected.

 

“Commander Sturgis.”

 

The younger man chuckled “No sir. My first name is Sturgis.”

 

“AH. Sturgis.  You will never know how good that breath tasted.”

 

“I’m a submariner … well former…”

 

“A bubble head!”

 

“Yes sir.  So I think I empathize with that breath.”

 

Matt slapped him on the shoulder. “Thanks again Sturgis.”

 

“Sir may I offer a confession?” He didn’t wait for an answer. “If I had returned to JAG without you, neither the Admiral nor myself would have been fit for dog food.”

 

They headed towards the car. “Mac can be a force to be reckoned with.” Matt chuckled.

 

“Sir… you have no idea.”

RABB’S RESIDENCE

 

“Harm I don’t want to talk about this!” Mac repeated for the third time.

 

“Mac you have nothing on this man.” Harm continued unperturbed.  “You are going to bring in experts to testify on rumour and innuendo and that’s it.”

 

“You telling me how to run my case now?” She snarled. “I can’t believe you are brining this case home.”

 

“Mac I know you and how you will run the case.” He insisted.

 

“Did it EVER occur to you that I’m a damn good lawyer!” She bristled.

 

“You’d better be I taught you everything I know!” He chuckled.

 

“No; AJ Chedwiggen did that! And you do good to learn from him!” On that point she picked up her pillow and headed for the guest room.

 

Only then did Harm realize how far he’d pushed.  “Damn.” He grumbled to himself. He’d have to steer clear of Mac till she cooled.

DIY STORE

 

Bud stood and felt lost.

 

“May I help you sir?” a young woman approached the dazed father.

 

“Er I need to build my son a tree house…”

 

“… and you don’t know where to start.” She finished.

 

“I’m a lawyer.”

 

“Have no fear I’ll take you though it.” She assured him.

JAG COURT ROOM

 

Admiral Morris the presiding Judge in the case took one look at the lawyers in the case and said “Well I’m glad I’m not staying at your house during this trial.” He couldn’t help it he had to comment.  “Is the Government ready?”

 

Before Mac could respond Harm jumped up.  “You honor the defense would like to object to this whole proceeding. The Government has no case and is seeking to railroad my client.”

 

“Commander.” Morris removed his glasses. “You may not seem to have any confidence in the Government’s case but I assure that I do and if I find out that they are indeed wasting the Court’s time I will deal with it. Understood Colonel?”

”Understood sir.” Mac assured him.

 

He replaced his glasses. “And so I say again is the Government ready to present its case?”

 

“We are you honor.”

 

“Then let’s proceed!”

ROBERTS’ ELEVATED RESIDENCE

 

The Roberts men had left Harriett to her own devices and were in the newly built tree house.

 

“So how’s school?” Bud asked.

 

“Dad?”

 

“Yes son?”

 

“Thanks this is a great tree house.”

 

“You are welcome son.”

 

The two just laid back and watched the stars.  No case Bud had ever won had ever given him such a feeling as this night.

JAG COURT ROOM

 

The verdict was short and swift.

 

“In the case of the People vs Lt. Col. Avery Dax we find the defendant guilty.”

 

The gavel slammed down and the Judge announced, “Sentencing will take place tomorrow at 1400.”

RABB’S RESIDENCE

 

Matt had had it enough was enough! The Marine took charge.

 

“When I first met you on that Mountain I thought that may be just may be you were the man for my niece.” He railed at Harm.

 

“I really thought you all would know better and when you got married I said AMEN they see sense finally! You took damn long to get there but you did.  But this?  You all are acting like children!  If that’s how you want it I’ll lock you all in a room until you all kiss and make up!” He ranted.

 

“You want to be locked up in a room with me?” Harm asked Mac.

 

“By this old man?” she replied.

 

“Hey who you calling old!” Matt objected.

 

“I’m sorry.” Harm apologized. “I said some things that were way out of line and I didn’t know how to fix it. I love you Mac.”

 

“Oh good.” She smiled “Cause I love you too.” 

 

Harm reached over and kissed her.

 

Matt left the room he had no intension of being witness to that reunion.
