We James R. Cody & Zedekiah Cody in consideration of one dollar to us paid & the other consideration hereafter named, do hereby sell assigne transfer & convey to F. M. Fulkenson as trustee a tract of land lying in the 5th civil district of Hancock County Tennessee containing fifty acres more or less. Adjoining the lands of G. W. Seal Mahala Cody W. D. Jarvis, the heirs of Salathial Riley and perhaps others. Lying on Richardsons Creek and on the east side thereof. Being the tract conveyed to us by W. G. Seal by deed to which reference is made To have to hold the said tract of land to him the said F. M. Fulkenson his heirs and assignes in fee simple and do covenant with him that we are lawfully seized of said land that we have a good right to convey the same and that the same is unencumbered. We do further covenant with him to warrant the title of said land against the lawful claims of all persons whatever But the above conveyance is made in trust for the following purpose and none other that is to say. There was a judgement rendered by A. J. Livesay a Justice of said County about the month of June 1891 in favor of the firm of Cowan McClung & Co & against the firm of Z. Cody & Bros. Or against one or more of the members of that firm for about the sum of $240.00 & cost of suit. Which Judgement & cost remain unpaid and we being desireous to secure the payment of said Judgement & cost make the above conveyance for that purpose. Now if we should pay off said Judgement with interest & cost within eight months from this date the above conveyance is to be null & void of no effect But if we should not pay off the same within the time above specified then the said F. M. Fulkenson trustee is hereby empowered and authorized to advertise & sell said land at the court house door in Sneedville or at the residence of W. G. Seal after advertising the same for thirty or more days in writing at five or more public places in said county. One to be posted at said courthouse door & one at the millhouse door & one at the mill of W. G. Seal & sell the same for ready money free from the equity of redemption & out of the proceeds of the sale he will first pay the expenses of this trusty. He will next pay of said Judgement interest & cost & the remainder if any he will pay over to us. Given unto our hands the day of Sept 1891

This deed is on file in the Sneadville Courthouse, Sneadville, Hancock County, Tennessee.
Forgetting the habits of a small town on Wednesdays, I arrived at the courthouse a few minutes before closing. A rushed visit resulted in the deed copied for me by a gentlemen and I failed to get the number of the deed book or witnesses.
If anyone should happen to know this information I would be grateful.
Although most of the Hancock County records were destroyed by fire, there are two old deed books in the back room.
