Terms and conditions of auction 2009

  1. Prior to the commencement of the Auction, each intended bidder shall complete the Auction buyers Registration Form and shall receive an Auction Buyers Bid number.
  2. The highest bidder shall be the purchaser, and in the event of any dispute, it shall be settled by the auctioneer.
  3. The terms of the Auction are strictly cash unless prior arrangements are agreed to by CBS Inc. executives. All birds purchased are to be paid for at the conclusion of the Auction.
  4. All birds shall be at the risk of the vendor until the fall of the hammer, where after each bird shall become the risk and expense of the purchaser and shall be taken delivery of, with all faults and errors of description, except where otherwise undertaken by the vendor.
  5. The Auctioneer expressly reserves the right to refuse any bid or bids without indication, grounds or reasons therefore.
  6. The Auctioneer is to be considered merely the agent between vendor and purchaser. Any disputes arising from defect, wrong description, ring number or otherwise must be resolved by the purchaser and vendor. No lot is to be returned to the Auctioneer.
  7. No lot will be released from the Auctioneers custody until full payment has been made.
  8. Only C.B.S. Stewards are permitted to handle birds or cages during and after the Auction.
  9. If a bid fails to reach the reserve price, the bidder who has made the highest bid will then be given the opportunity to purchase the lot at the reserve price. If the bidder is not interested, the lot is then on the open market.
  10. Birds sold after the Auction through negotiation must be recorded with the stewards and commission is payable to the Capricornia Budgerigar Society Inc. at the set rate.
  11. On behalf of the Capricornia Budgerigar Society Inc., I would once again like to thank all the exhibitors who entered their birds for this event, as well as all those who have supported this auction. We trust that everyone attending this event enjoys safe travel and has a successful day at the auction.

    CBS Inc President
    Brian Lewandowsky.
