II. Contemplating Divorce? Here's What to Expect...
YOUR METHOD OF CALCULATION: So you're contemplating divorce but you don't know what to expect.
Using Murphy's Law, it's the worst possible outcome of any given situation. You'll be using a barrel for clothing and eating your main course out of a can. The other side of the spectrum would be you, with all your property, possessions, and sanity, ending up with
your ex paying you support. Don't count on that happening!!! (LOL!!!)
It's important to see the possibilities through the eyes of the people who may break you: the divorce lawyers.
It's their perspective which will give you the answers to some of your unasked questions. Here are some general rules of thumb from an article by Joseph Cordell, divorce lawyer, to a potential bread-winning divorcee from the website http://www.dadsdivorce.com
If the maintenance order itself is going to be a close call, i.e. the evidence could easily warrant no maintenance, then chances are it will be terminated in three years or less.
If the wife is under 40 and healthy, maintenance will stop in less than five years, if under 30 and healthy, in less than three years.
Conversely, when the wife is over 50 years of age and it is a ten-year marriage or more, she will likely receive maintenance until your retirement.
For marriages of less than ten years duration, maintenance will rarely go beyond five years. Conversely if a duration of more than twenty years, the maintenance will likely persist beyond ten years.
In a second wives' club scenario, where husband wants out because he has met someone else and wife is in her mid-forties or older, the court tends to be more generous with maintenance both as to amount and duration. (I believe this tendency exists even where misconduct is not a lawful consideration).
If husband makes a ton of money (ton = $150,000+), he is likely to pay at least several years longer, all other things being equal, than his less moneyed counterpart.
All other things being equal, a husband will typically pay maintenance longer if he is in a rural county than in an urban county.
Remember that in legal language "maintenance" means support payments. This does NOT include any child support or mortgage payments. The article also mentions "needs" may change for the wife, so you may have an adjustment when those needs are updated.
Such are the field you may have to play in the Divorce Bowl. Remember the conditions change daily, so you might want to get fitted for that barrel...
... or, you can plan ahead to protect your wealth.

V. Privacy and Your Social Security Number
Have you ever wondered how the "bad-guys" know so much about you and your "private" business?
Simply stated- your SOCIAL SECURITY NUMBER.
All I need to learn your "private" business is your name and address. For less than $200 I can hire a private investigator and the investigator will trace your every move for me. He does this by cross-referencing your name and address to your SSN.
Now, suppose I'm a real "bad-guy" and I want to learn about your financial activities... I pay another contact about $150 and I can gain access to your bank and credit card information.
In short, for about $300 I can track your activities and learn all about your "private" business once I have your SSN.
Scary stuff!!!
Fortunately, there are ways to "disappear" from the public eye.
About a year ago, a prospective client hired a private investigator to "check me out". When he received his report, he shared it with me.
The results of the search were very predictable: In my life "before implementing privacy strategies", I owned a number of rental properties and automobiles in my name - these showed up on the report.
After the implementation of several privacy strategies, including the use of Pure Trusts, my activities simply "disappeared" off the radar screen. Today, there are absolutely no property records reflecting ownership of assets by me.
THIS is the greatest form of protection from litigation available on this planet!
Even if a very determined (hungry and ignorant) attorney succeeded in obtaining a judgement against me, he'd be eating donut holes because I don't have anything that he could attach a judgement to.
Better than that, just by being "off the radar", most attorneys won't bother because the investment/reward ratio just doesn't pan out...
VI. Privacy Tools
Maintaining your privacy is YOUR responsibility. Fortunately today, there are many products being developed to help you in your quest for privacy.
The internet has spawned the "need" for the development of a whole host of privacy product categories.
In past messages, I've discussed the use of tools like PGP encryption software. http://www.pgpi.com (If you still do not have PGP and would like to download it and learn how to use it, send me a note requesting the articles written about PGP and I'll get them out to you.)
Recently, a tool has surfaced which will allow users to purchase goods and services anonymously- "stored-value" Cards.
There are many types of "stored-value" cards appearing on the market. Some provide anonymity, while others do not.
For instance, VISA is offering a "stored-value" card for teenagers, named "VISA BUX" Card. To obtain this card, the teen's parents complete an application and provide their Social Security Number and bank account number, and the Social Security Number of the teen. NOT very private.
Earlier this past week, a business associate of ours announced that their company secured an agreement with a "stored value" card company which provides TOTALLY ANONYMOUS ATM Cards and another which provides TOTALLY ANONYMOUS MasterCard Cards.
These are really slick!
These cards can be used for many purposes; you use them just like any ATM card or MasterCard- ONLY THESE CARDS ARE TOTALLY PRIVATE!
NO SSN; NO ID; NO CREDIT HASSLES!!!
Prior to this product's availability, about the only way to achieve similar privacy while obtaining the convenience of "plastic money" was the use of offshore debit cards.
Compared to offshore debit cards, using these "stored-value" cards is much simpler and much less expensive.
