Matt,
This is a tough issue for a veteran like myself, not to mention a candidate for Congress. And to be honest, I once came down on the same side as you. However, after doing a little research, I now support a Constitutional Amendment to prohibit desecrating the flag.
Here's why:
First, the liberals want it both ways -- they want to make desecrating their gay rights flag a hate crime. I could never support that, but there is a significant difference regarding their flag and Old Glory. Forty-nine states have passed laws or resolutions to, within their borders, protect the U.S. flag, and in every case, the supreme court has declared that unconstitutional. To make a long story short, the U.S. Supreme Court failed by even hearing these cases in the first place, because it's now a State's Rights issue (10th Amendment). In effect the U.S Supreme Court has created a constitutional crisis (1st VS, 10th Amendment contradiction), and the only check and balance left on the Supreme Court is to amend, a process made available by you guessed it, the U.S. Constitution. But frankly, even though I would strongly support it, it will probably never happen. Besides, I would prefer to spend my time and energy mitigating, or better yet repealing the 16th Amendment. That is the best thing we can do to get the federal government off our backs, as well as dispose of an activist Supreme Court.
Keep in touch,
John Mitchel
