The state legislature has revised ARS 13-1308, and these revisions have passed the 90 day challenge period and gone into effect. 13-1308(C)(5) specifically forbids any municipal government in Arizona from prohibiting the posession of firearms in a park or preserve of one more more square mile in size except in posted developed or improved areas. In smaller parks and in developed areas of the large parks, the city may restrict posession of firearms to those posessing permits to carry concealed weapons.
Yesterday I noticed while hiking in an unimproved and undeveloped area of the Reach 11 Recreation Area in northeastern Phoenix that signs continued to declare that firearms and other weapons were prohibited in this area. I am given to understand that these signs also remain up in Papago Park, the North Phoenix Mountain Preserve, and South Mountain Park, all parks or preserves of more than one square mile in size. Even without the revision to 13-1308, no city code exists prohibiting firearms or other weapons in these parks and preserves, so the signs were fundamentally dishonest. Now they are in direct violation of state law and must be altered or removed.
I ask that the Parks and Library Department immediately conform with the law by either replacing the signs with new signs which conform with the law or by simply painting over the portions of existing signs which claim that posession of weapons is prohibited. Thank you for your time.
