BUSINESS OF THE
DMC WEST Areas within DMC West. The areas falling within
the jurisdiction of the District Municipal Corporation
(West) are specified in Schedule-I.
Functions of the
DMC. The
functions of the District Municipal Corporation (West)
are given in Schedule-II.
Departments. Departments are
mentioned in Schedules III-A & III-B.
Business of
Departments.
The business of the Departments is given in Schedule-IV.
Head of
Department.
The heads of departments shall:-
works directly
under the control of the District Municipal Commissioner.
exercises the
powers delegated by the District Municipal Commissioner.
is responsible for
efficient administration and for the proper conduct of
business assigned to his respective department.
makes proper and
equitable distribution of work among the officers
subordinate to him and review such distribution from time
to time.
is responsible for
conducting the business of his department in the meetings
of the Council Committee or Sub-Committee.
submits cases to
the District Municipal Commissioner.
assist the chairmen
and District Municipal Commissioner in the formation of
policy.
executes the
sanctioned policy.
keep the District
Municipal Commissioner generally informed of the work of
his department and important cases disposed of by him.
suggests a definite
line of action while submitting a case for orders of the
District Municipal Commissioner.
resubmits the case
to the District Municipal Commissioner inviting his
attention to the relevant rules, bylaws or government
policy where the orders of the District Municipal
Commissioner or Chairman appears to involve a departure
from rules, bylaws or government policy.
issues with the
approval of the District Municipal Commissioner in this
behalf standing orders specifying the cases or class of
cases which may be disposed of by an officer sub-ordinate
to him.
maintain
coordination and liaison with the councils
committee and assist the committee concerned:
in the event of
difference of opinion between the departments, the Head
of the Department primarily concerned shall submit the
dispute to the District Municipal Commissioner for
orders.
all cases submitted
to the Chairman shall be routed through the District
Municipal Commissioner.
Transaction of
business.
The business other
than the business transacted in the departments shall be
transacted in such manner as the District Municipal
Commissioner may determine.
Executive
action.
Every executive
action of the Council shall be taken in the name of the
council.
Note of the
Council.
Note submitted to
the council shall include council a summary containing
the relevant facts, points for decision and specific
recommendations.
Reference to the
Government.
No reference of
important and ordinary nature shall be made to the KMC
and Government except the approval of the District
Municipal Commissioner/Chairman.
Disposal of
business.
The Administration
Department shall issue the business of the department not
provided herein instruction as to the manner of disposal
of business.
Every order shall
be passed in writing and in case of verbal orders the
officer receiving it shall reduce it to writing at the
earliest opportunity and confirmation thereof shall be
obtained.
If any order
contravenes a law, rule or policy decision it shall be
the duty of the next below officer to point it out to the
authority passing the order.
Contracts.
Contracts shall be
made or executed on behalf of the Council in accordance
with contract rules - 1980.
Consultations.
When a case
concerns more than one department the department
primarily concerned shall consult the other department
before issuing any order or submitting it to the District
Municipal Commissioner or Chairman.
When a case is
referred by one department to another for consultation
all relevant facts and the points for consideration shall
be clearly stated.
A department may
for the purpose of information transmit a copy of the
communication or show/case to such other office if it
considers to be of any interest or profit to them.
Acknowledgment.
Every communication
received in a department shall be acknowledged, carefully
considered and disposed and particular attention shall be
paid to those items of works in which action is required
on application soliciting permission assistance or
specified services.
Instrument.
An order or
instrument shall be signed by the head of the
departments, except in cases , where an officer has been
specially empowered to do so.
Period of
disposal.
Every head of the
department shall as far as possible prescribe
standardized periods of disposal for various categories
of references with in his department or office.
The working of
standardized time limits shall be vigorously enforced.
Arrears list.
The monthly arrears
list shall be prepared regularly in each department and
office.
The heads of the
department shall examine the list carefully and ensure
early disposal of arrears
The head of the
department from time to time make surprise checks to
ensure strict compliance of paras 15 and 16.
Administration
Department.
The administration
shall be consulted in all service matters.
Concurrence of
Finance Department.
No department shall
without prior concurrence of the finance department issue
any orders which directly or indirectly affects the
finances.
Communication to
the press.
No servant of the
Council shall unless generally or specifically authorized
in this behalf communicate to the press, officials
belonging to other Government offices or any private
individual any information required directly or
indirectly from official record or in the discharge of
his official duties.
The administration
department for treatment and custody of the official
documents and information of a confidential nature shall
issue detailed instruction.
Official news or
information shall ordinarily be conveyed to the press
through the public relations office in the manner
prescribed by the department.
No person other
than the District Municipal Commissioner shall act as
official spokesman of the Council.
Correspondence.
The District
Municipal Commissioner with the provincial government
shall conduct correspondence in respect of subjects
allocated to a department.
No officer or
servant of the Council shall approach the higher
authorities without the prior approval of the head of the
department.
No servant of the
Council shall make direct correspondence with the higher
authorities.
Law Department.
- Responsibilities
include:
- Legal
questions.
- Interpretation
of any law.
- Feasibility
of instituting or
defending civil or
criminal proceedings in
which Council is involved
- No department shall
finalize the drafts of statuary
rules, regulations, notifications
or orders unless the law
department vets them.
- The law department
shall vet every legal document
sent by a department of office.
