It was determined that at this time that the paraphernalia laws could not protect the pipe as the law states that its traditional use is for the consumption of tobacco. Under current laws, any item that has a" traditional" use for smoking tobacco is not considered drug-related use, unless residue of a controlled substance is found in or on the item. Mr. McMahon, the committee attorney that I was working with, did state that current Illinois law pertaining to the drug paraphernalia is very out dated and needs to be revised. I would like to thank Sen. Judy Myers and Mr. McMahon for their diligent help in this matter, as I know they worked very hard on this issue.
