Purchase Contract And Warranty
This contract made and entered into on this _____ day of 2000, by Bob Armstead, Hereinafter referred to as the seller/breeder, and __________________ , hereinafter referred to as the buyer. That for and in consideration of covenants and agreements herein stated, the seller/breeder agrees to sell to said buyer a (Breed) __________ (bitch/dog), hereinafter referred to as animal and further described as:
Name: Date of Birth: Sire: Dam: The above animal is purchased under the following conditions and warranties. No other warranties or conditions are either expressed or implied.
1. Full payment for the animal will consist of $ ______.00, or ______.00, to be paid in even monthly payments totaling ____.00, With the final payment to be made no later than __ months receipt of the animal.
2. Seller/breeder guarantees the animal to be in good health at the time of purchase. Buyer is responsible for taking the animal to a veterinarian for a health check within forty-eight hours of receipt. The animal may be returned within seventy-two hours of receipt and any monies provided to the seller/breeder will be returned and this contract will be terminated.
3. Seller/breeder guarantees that the animal is purebred and registerable with the American Kennel Club, hereinafter referred to as AKC.
4. Seller/breeder further guarantees the life of this animal against congenital defects for the first twelve months of the animal's life, If the animal should die due to a congenital defect within the first twelve month's of life, it will be replaced after the seller/breeder has received proof and reason of death consisting of a veterinary death certificate. The replacement animal will be transported at the buyer's expense and must be provided within two years of death of the original animal.
5. Buyer agrees to have this animal x-rayed for hip dysplasia at the age of twenty-four months and to send the x-rays to the Orthopedic Foundation for Animals, hereinafter referred to as OFA, for evaluation of hip dysplasia. Address for OFA is Orthopedic Foundation for Animals, 2300 N. Boulevard, Columbia, Missouri, 65201. Buyer agrees to send a copy of the OFA final evaluation to the seller/breeder by the age of twenty-six months, If the animal does not receive a ,"FAIR" or better evaluation, the animal may be returned to the seller/breeder at the buyer's expense for a replacement animal. If the buyer desires to keep the animal, it must be rendered incapable of reproduction and a letter from the veterinarian performing the operation must be provided to the seller/breeder. A replacement puppy will then be sent to the buyer from the next similarly bred litter, at the buyer's expense.
6. Buyer agrees that the animal will not be used for breeding until the age of twenty-four months and OFA certified, "FAIR" or better for Hip dysplasia.
7. Buyer assumes full responsibility for the animal. Care, feeding, and veterinary costs for the animal are the sole responsibility of the buyer.
8. Buyer agrees to take proper safeguards for the care and safety of the animal, including but not limited to a fenced yard, proper shelter, adequate feeding, exercise, proper veterinary care, and training sessions not to exceed the following agreed to level: (circle one) house manners, "CGC", CD, BH, CDX, SchH I, SchH II, SchH III, TD, TDX, VST, FH1, FH2.
9. Buyer agrees to return the animal to the seller/breeder at the buyer's expense if no longer able to care for the animal or failing to meet the terms of this contract
