The potential for folio numbers to revive when there is a lack
of clear procedures for cancelling and archiving land title documents is
apparent in the case of folio 3195/27.
This folio is the parent folio (the folio from which other properties
are derived) of many of the titles in the subdivision including my own title
folio 4267/27.
This folio 3195/27 was cancelled however on 18-5-1992 after the issuing of folio 4880/2. It should be noted
that folio 4880/2 is described as lot 1 on plan 53249.
However even though folio 3195/27 was cancelled in 1992 it is apparent from the list of dealings below
that a dealing has been lodged on folio 3195/27 on 26th November, 1993.
It is obvious that the priority notice is not a registered dealing, but what is interesting is that any
dealing at all is able to be entered on a folio which was cancelled some 17 months previously.
1.How does a priority notice come to be recorded under a file number which was cancelled 17 months
previously?
2. Does the fact that folio 3195/27 still appear to be active affect all the other folios which have
been subdivided off this original parent folio?
