3-  I believe Stocks can be set aside from estate.  "T.O.D" status can trigger ownership to Beneficiary as value at "time of death", with no probate.  Sales of any or all stock - Only then, becomes taxable.  Perhaps you know something about this, Tim.  It may be necessary Tim, to make a "will" simply to protect benefits, by naming a Beneficiary who would hopefully respect my wishes for Carla and Pray time permits me to move away from New York.  I have concerns against Carla's suffering beyond anything any human being should be forced to endure, and naturally, "I" must never get in the position of draining assets earmarked for her eventual care.

  Secondly and most important, is to find a state who will honor the wishes of a parent and/or guardian appointed to act "in Carla's best interest."  I am sure that a state with a "heart" still exists.  If you were ever in my position Tim, it is my belief you too would feel as I do having dealt with and having undergone such "ungodly" experience here.

  My blood pressure returned to 120/(64) odd, but considered OK.  I hope to get a letter off to the Appellate tomorrow regarding my long-standing illness, a debilitating condition brought on by continual legal turmoil.  They have thus far shown a desire to allow fairness, and I believe the Justice's in the Third Judicial District will uphold my right to "equal access to the law", as is enjoyed by Ziff and his law firm.  Tim, it is reprehensible that to date, "Fraud" can be used to seriously dehumanize and financially crush a citizen when initiated by an "Officer of the Court."  Nowhere in our society is such travesty allowed!  But to steal a loaf of bread or quart of milk to feed a hungry family draws a write-up in the newspaper and a trip before a judge.  I am sure you witnessed many such instances.  At the very least, the merchant has a right to bring his charges to recognition without a heavy financial burden placed on him.  I don't mean to whine or cry, but my shoe, on your foot, traversing a mile of ground, would help you better understand my position in this matter. 

It just never ends, Tim. Hopefully, You will never again see a case where harassment to the degree initiated against a (primary care giver) was allowed by the law, (a misdemeanor - in NY State). Penal Law 260.25 deals with endangering the welfare of an incompetent person and I believe it could be argued to include the diversion of attention and care provided by the care giver of said disabled person.  For the benefit of those who might follow me in such future endeavors Tim, I believe it is important to test my theory in a different venue.

 Tuesday, What was becoming my best stock market year turned out to be my worst!  I was unable to devote the necessary time to manage my portfolio as before.  Additionally, Carla suffered many problems since the Village and Ziff's "theft", against us.  It was made very clear long before Judge Castellino (who incidentally Tim, had first hand knowledge of Ziff's quitting as my attorney while presiding over Carla's guardianship case in Surrogate's Court) took the Supreme Court bench, that neither Ziff nor anyone else had any further claim to Carla's assets.  I telephoned and spoke directly with Judge Ellison and on another occasion, Tim Eckel, his law clerk.  Mr. Ogilvie also reinforced those concerns, but it is doubtful anyone will admit it now, however to be wrong would be blessed, and "good" people do still exist.

  I will close for now Tim, it is time to return Carla to her backside and feed her, (3:51 AM.)  To one of the "good" people, please consider my thoughts and get back to me with your views and counsel.  As a second thought Tim, I see John Trice as compassionate, honest, and may be an answer to my prayers by assuming beneficiary status of my will, at least in the interim.
