Ziff  vs Sindelar's Mr. Bertram A. Ziff, Esq. agreed in 1990 to handle four legal cases for us.
Date Action Short Description
Nov 15 1993
Mr. Ziff's explains his Fee
Mr. Ziff references an "agreement for all matters", "kept no records", And "agreed as friends to $25,000."  He makes no reference to the "CONTRACT he Tricked me Into Signing".
Oct 25 1993
Explain basis for your Fee
1 1/2 years after he Quit representing us, Ziff still had not explained the basis for the Fee he pursued through the Court & Insurance Co. liable for Carla's accident.
Nov 04 1992
Mr. Ziff breached a verbal Agreement arrived at prior to our Oct '91 discussions
My response to Ziff's "self appointed representation", after he Quit all of our legal matters.  he breached any agreement we had which was "fuzzy" at best, and the $25,000 fee, his "Mad Response" after an argrument.
Oct 27 1992
Take immediate steps
His "self appointed" representation & "urging" amazed me!  Prior to convincing me to let him handle Carla's lawsuit, he said his wife Eleanor told him, "Bert, how can you even take one cent of Carla's money?" None-the-less, had he settled it, I was willing to pay a reasonable fee.  If in fact we had an understanding regarding his ($25,000 fee), why did he not return Carla's files?

Plea, Ziff's Illegal Resignation
My Plea to Hon. Patrick J. Monserrate to dismiss four sanctions lodged against him for various failings as an attorney in handling "Sindelar vs. Fritzsch & Randi."  Note reference to "true facts regarding the $25,000."
Apr 23 1992
Judge Monserrate proposed Sanctions against Ziff
Judge Monserrate proposed Sanctions against Bert for failure to turn over certain items, and most importantly for not appearing on a scheduled court appearance.

Resigned Guardianship $25,000 fee agreement typed on Court Petition
I question the legality of an Attorney to make his fee agreement part of a Guardianship Petition, and to Notorize a document he has a financial interest in.  Certainly it cannot be Ethical to do so.  What do you think?
Apr 06 1992
Resigned Lawsuit
After Quitting Carla's Accident Lawsuit, Ziff still received Supreme Court Order to be paid $25, 424.94.  No, I am not joking!
Mar 16 1992
Guardianship Petition
Tricked into signing Fee Agreement typed on Guardianship Petition.  Who would read a lengthy, legal document when their attorney insists you hurry and sign it because "...we are late getting over to Sammy's Court...," to fight for your childs right to remain home with you?
Feb 27 1992
Resigned Medical Malpractice Lawsuit
After failing to agree on attorney fee's, method of settling law suit (as felt by Carla's mother and I to be in her best interest), and a complete lack of competency in other legal matters, Bert decided not to pursue Carla's opportunity to seek additonal income to help offset expenses, present and future resulting from negligence in a surgical operation.
Apr 08 1992
Watkins Glen DA
DA Connie Fern Miller (an Honorable Lady District Attorney) showed compassion in helping me save our home from an "Attorney Scam" at a time when Ziff had reflected an incompetency in doing so.
Oct 25 1991
Proposed settlement & fee
Against my direction, Bert Ziff proposed a settlement felt not in Carla's best interest
