"I don't know whether you have already heard, or not, that there was an article in the Laredo newspaper regarding some decision by the feredal court in the case. Well, it was saying that the federal judge had commuted the sentence from death to life. However, I'm trying to to get the word out to as many as possible that it hasn't happened ...yet. You have won half the battle..My prayers are with you...Sandee Martinez to miss death row Prosecution error is key to commuting original sentence BY ROBERT GARCIA Times staff writer District Attorney Joe Rubio has signed off on an agreement that will commute convicted capital murderer Miguel Angel Martinez's death sentence to life in prison, if the defendant meets certain obligations. Rubio said Thursday that the agreement was formulated by the Texas Attorney General's office and Martinez's appeal attorney, Cynthia Orr. Martinez was convicted in 1992 and sentenced to death under the law of parties for the ax murders in 1991 of James Smiley, Daniel Martinez and Daniel Dueñez. All three victims were killed at Smiley's home in north Laredo. Orr said Martinez was shaken and began crying when he received the news of the commuted sentenced. He told the attorney that he wished he could pay them for all the hard work. "I told him just getting you off death row is payment enough," said Orr. Martinez asked the attorney to please notify his family, she said. The Laredo man was for some time the youngest person on death row. Orr said it was the quality of evidence at the original trial that was at issue and led to the commuted sentence. "We spoke to the parents of one of three victims (Smiley family) and they approved the agreement also. We have been unable to find the parents of the two other victims," Rubio said. For months the attorney general's office and Orr, who has been representing Martinez in his appeal process, have been working on a writ of habeas corpus at the federal level under a protective order to re-inspect the evidence used against Martinez. In a statement released by Orr, the attorney said that after nine years the state attorney general's office for the first time is confessing to an error in a capital murder case with respect to the case's sentencing process. The end result is that Martinez will be released from death row. "He never belonged on death row," said Orr. The commuted sentence agreement grew out of a hearing in chambers with Federal District Judge Keith Ellison after a writ of habeas corpus was filed. Ellison expressed some concern over evidence in the Martinez case handled by former San Antonio forensic serologist Fred Zain. Zain's work was discredited in 1993 when the U.S. Supreme Court ruled that the former serologist had either fabricated or misrepresented evidence. Rubio said Zain's testimony in the Martinez conviction has never been questioned. The issue was raised by Martinez's attorney some two years ago before Visiting Judge James Barlow, who denied the defendant a second trial. Zain took the stand during that hearing and plead the Fifth Amendment against self-incrimination. Orr said that while the court did not specifically address Zain's testimony in Martinez's case, it was one of the reasons among many others. The DA said Thursday in order for the commuted sentence agreement to go through, Martinez must provide prosecutors a "proper statement," or his version of what happened in the January 1991 triple-murder case. The statement he makes when Martinez and his attorneys meets with local prosecutors has to be consistent with the confession he provided police when he was arrested some five days after the murders. Martinez also has to be available to testify truthfully against co-defendant Miguel Angel Venegas when he goes to trial. Let us not rally to fight these people...but to soften these people. They are in need of help almost as much as Miguel. Read their pain through their anger. Any person who is angry enough to p omote the destruction of a human life is hurting--remember that. I've been to jail...no, not TDC, but a boot camp and a county jail. I did not fit in...I went there convinced that our justice system dispersed just that...justice. When I came home I was changed. The people that I was able to communicate with and share stories with opened my eyes, before then having worn rose-colored glasses I was unaware of the true ways of this world... I cannot rail angrily against the system and expect to promote change-but I can share stories like Miguel's with every person I ever meet...furthering peaceful information that will spur correspondence with the correct officials and hopefully, one day, we shall see a change in the way "justice" is handled by our elected... And remember...they are OUR "elected"...do not bitch if you do not vote...peaceful change is permanent change. Ive been at different chats talking about this case. It really beats me how some ppl dont give a damn about whats happening in their country. I mean the US is one of the worlds leading democracy and there's soon a new century coming up and they're still condoning the death penalty. I dont see how the goverment can support execution cos they should've known by now that it doesn t make less problems nor does it help a society to get any better by killing people. I read in a newspaper some days ago that the American society pays about 26 million bucks for a person thats been on death row for about 12 yrs and which they're gonna execute later while if they put that person in jail for life instead it'd only cost about 5 million bucks. Why not do something else with this money and realize that condoning the death penalty only shows our kids that is ok to kill other ppl. They have to realize that by executing ppl that are "abnormal" and sometimes even innocent doesn't mean that other ppl wont commit crimes. There's no guarantee. |

How could something like this happen in a so called civilized society?? It makes me so upset and I really want to make a difference! I would like to know how the people who are manipulating this case are able to live with themselves! If the death penelty should be put on someone it should be on those who aren´t honest and tries to put the blame on a suitable scapegoat. This is really raging me! Its been a while si ce I saw the documentary, but I still dream nightmares when I try to imagine what it must be like walking in Miguels shoes. I would like to know what kind of unhuman nature the judge is of?!!?He seems to be a true ashole! The fact that the people who refuses to give Miguel another trial shows how guilty of crime THEY are! Finally I would like to give my strongest support to you Miguel, be strong and never give up! I know there is a lot of people around the world praying for you. I refuse to believe that there isnt anything that could be done for you, you just hang in there and keep your hopes high! If there is a God, he/she will make the truth win!! :o) |
