Q: At an annual election new officers were elected to office. Subsequently it is learned that one of the officers did not qualify as a candidate. Specifically it states in the bylaws that an officer must be a member for at least 3 months before he/she may be considered. The elected officer was a member for only 2 months. It is now one month later. Do we accept the election or can a point of order or motion be made to reconsider or revoke the action of the body. - Sidney Gold, MD, Feb. 1, 2000

A: The simplest way to handle this would be for a member to raise a Point of Order, followed by the chair deciding that the Point is well taken. The chair would then declare the office vacant. Then follow the procedure specified in your bylaws as to how to fill a vacant office. It's possible, if things such as previous notice are orchestrated well, your association could elect to fill that office immediately - perhaps with the member originally elected.
