Parliamentary Procedure Q&A
Q:
A motion is adopted at the regular membership meeting.
A day or two after the meeting, it is determined that the passed motion violates either the constitution or the bylaws of the organization.
Is the passed motion still valid?
- A.A., Nov. 28, 1999
A:
No.
The motion is out of order.
See RONR p. 337.
At any time any member may make a Point of Order to that effect; the chair should then declare the point well taken, thus officially - and for the record - nullifying the vote.
See RONR p. 251.
