Q: What should be done if, when there is an election, you find that members not eligible to vote have voted? Do the officers in charge of the counting have the right to discard these ballots or must they be held in a separate envelope?

A: The ballots you identify as having been cast by ineligible voters are excluded from the count, but there is no requirement that they be held in a separate envelope. If there is some evidence that ineligible voters have cast ballots, but you can't determine which ballots they are, and if these ballots could effect the outcome of the vote, then you must take the vote again. Unless no date is previously agreed upon, an amendment to the bylaws takes effect immediately upon its adoption. (RONR pp. 590-591.)
