Mishnah - Instruction
Scholar Super People: This law means large bails and fines are not allowed. Cruel and unusual punishments should not be inflicted on other persons. the purpose of this law is to keep persons from charging people bail and being cruel to someone. My explination of this law to someone younger would be extreme bails and fines should not be required. And that cruel and unusual punishment should never be inflicted to another person. Scholar JAMB: The law says the punishment needs to fit the crime. For example, the death penalty cannot be issued for theft. This law was to prevent the judicial system from abusing power. The judges personal feelings are excluded from his final ruling. The punishment will be moral and civilized by preventing torture. And there are guidelines to prevent inventing new punishments. You cannot charge someone a lot of money to get out of jail, or overcharge them when fined. You can also not hurt them physically for minor offenses. |

Scholar Eclair: You cant make someone pay a very high bail for a minor offence. And you can't torture someone or cruelly punish them for any offense. The purpose of this law is to protect the people and restrict police and other court officials. When someone goes to jail for vandalizing a road sign, bail can't be $2,000. And if someone kills someone else, you can't torture the murderer before killing them, or senselessly beat them before jailing them. Scholar Me Bad: It means if someone like me were to get arrested, I would be treated fairly. I wouldn't be overfined or punished unfairly. They interpreted it very well. The other scholars said that with this law everyone is treated fairly and that no one shall be cheated in their rights. If you are charged with robbery, you cannot be put to death or pay an excessive fine. |
